Today's WER has an update on the Duke death cluster. Although the update still does not reveal the presence of D225G and D225N, and still claims it is not clear that the three fatal infections by the same virus at the same institution is the cause of death, the update does have demographic data on the four patients which helps sort out the five isolates deposited by teh CDC at GISAID.

Two isolates, NC39 and NC49 are likely from the same patient (43F), and the three patients proving samples in mid October at the likely three that had H274Y prior to Tamiflu treatment. Samples from a fourth patient were collected in early November, and it is likley that the three deaths were the three patients provinding the earlier collections. Each of these three patients had evidece of mixture. One had a mixture of D225G with wild type, another had D225N with wild type. while a third had H274Y with wild type.

Since all had HA Y233H, it is likely that all patienst were infected with virus with D225G, D225N, and H274Y, but collection sites and times determined the sequences palced on deposit.

Of the 56 cases of oseltamivir-resistant viruses isolated
from severely immunocompromised patients, 12 are related
to 2 clusters within hospital wards. The first cluster
of 4 oseltamivir-resistant pandemic (H1N1) 2009
viruses emerged at Duke University Hospital in Durham,
North Carolina, United States.4 One male and 3 female
patients, ranging in age from 43 years to 67 years,
with severely immunocompromised status, were admitted
to the same ward. The onset of influenza illness
occurred in a 2-week period between mid-October and
early November. While 3 of the cases were fatal, the role
of H1N1 infection in contributing to the deaths is uncertain.
In 3 of the 4 cases, the H275Y mutation was
identified before oseltamivir was administered.

WHO speak 101. The goal of the announcemnt is to make the reader think that the cases were fatal because the patients were immunocompromised. Thus, the statment needs to leave that possibility open (which is why the presence of D225G and D225N is not mentioned). The actual statement is worded so any ambiguity in any ONE of the three cases will make the statement true"

While 3 of the cases were fatal, the role of H1N1 infection in contributing to the deaths is uncertain.

Thus, if one family of one victim decided not to have an autopsy, the WHO statement which was made Dec 2 and repeated on Friday would be factually correct.
